These Terms govern ProCare Log, operated by SmartDataIQ LLC, an Arizona limited liability company. By accepting them, you agree to these Terms and acknowledge the Privacy Policy.
1. Eligibility and accounts
You must provide accurate account information, protect credentials and recovery material, and select an accurate role. You are responsible for activity through your account and authorized devices. Professional accounts may require identity, licensure, employment, or organization verification. ProCare Log is not intended for independent use by children under 13; guardian and regional age rules apply.
2. Not medical advice or emergency care
ProCare Log organizes and communicates user-provided information. It does not diagnose, prescribe, make treatment decisions, or provide emergency or continuous monitoring. Do not delay contacting a qualified clinician or emergency service because of information in ProCare Log. Connected-device readings and future automated explanations may be incomplete or inaccurate and must be independently reviewed.
3. User records and responsibility
You are responsible for reviewing information you enter, import, upload, or share and for having authority to provide information about another person. Clinicians remain responsible for professional judgment and their own documentation, consent, security, and retention duties.
You retain rights in content you provide and grant SmartDataIQ LLC only the limited rights needed to host, encrypt, process, back up, display, export, and share that content to provide features you request.
4. Patient-authorized sharing and family access
Patients determine the records and period included in a sharing session. Recipients must use information only for the authorized care purpose and may not attempt access outside that session. Revocation blocks future access through ProCare Log but cannot retract copies already viewed, photographed, downloaded, printed, or lawfully retained.
Family membership alone does not reveal health records. Access is controlled through separate grants. Account owners and authorized adults are responsible for granting, reviewing, and removing access appropriately.
5. Acceptable use
You must not:
- access records without authorization or impersonate another person or professional;
- evade security controls, probe the service, scrape data, distribute malware, or interfere with availability;
- upload unlawful content or information you lack authority to provide;
- use the service to discriminate, harass, exploit, or harm;
- use ProCare Log for emergency monitoring or life-critical control; or
- present app output as a diagnosis or substitute for professional judgment.
6. Connected platforms and third-party services
Apple Health, Health Connect, app stores, identity providers, and clinician systems are governed by their own terms. ProCare Log does not control information a recipient exports to another system. Store subscriptions, when offered, will be billed and managed under the applicable app-store terms.
7. Service availability and changes
Features may change or be unavailable. We may update security, eligibility, regional availability, usage limits, or paid plans. Material policy changes may require renewed acceptance. We do not guarantee uninterrupted or error-free service.
8. Suspension, termination, and deletion
We may restrict access to protect users, investigate suspected unlawful behavior, comply with law, or enforce these Terms. You may delete your account in the app or use the external deletion request page, subject to identity verification and lawful retention duties.
9. Intellectual property
ProCare Log software, branding, design, and original content are protected by applicable intellectual-property laws. These Terms do not transfer ownership of the service or its branding.
10. Disclaimers and liability
To the extent permitted by applicable law, the service is provided “as is” and without warranties that it will be uninterrupted, error-free, or suitable for a particular clinical purpose. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded. Each party retains all protections, obligations, and remedies provided by applicable law.
11. Changes
We may update these Terms. Material changes may be presented in the app and may require renewed acceptance. Continued use after an effective update constitutes acceptance where permitted by law.
